BZA Membership Requirements
Responsibilities
The board’s role is to ensure effective, fair, and timely administration and enforcement of the Town’s Zoning ordinance, promoting compliance while addressing unique circumstances. The board is responsible for hearing and making decisions on:
Administrative Appeals: Addressing appeals related to the interpretation or enforcement of this ordinance.
Conditional Uses: Evaluating and deciding on requests for conditional uses as outlined in the ordinance.
Variances: Reviewing and granting variances to zoning and land use regulations where warranted.
Appointment
five (5) members as follows:
- Three (3) citizen members appointed by the executive of the municipality, of whom one (1) must be a member of the plan commission and two (2) must not be members of the plan commission.
- One (1) citizen member appointed by Town Council, who must not be a member of the plan commission.
- One (1) member appointed by the plan commission from the plan commission's membership, who must be a citizen member of the plan commission other than the member appointed by the Town executive.
Member Eligibility
Members may not hold an elected office (as defined in IC 3‐5‐2‐17) or any other appointed office in municipal, county, or state government; except for membership on the Plan Commission as permitted or required in IC 36‐ 7‐4‐902. A member must meet one (1) of the following requirements:
(1) The member must be a resident of the Town; or
(2) The member must be a resident of the county and also an owner of real property located in Town.
However, at least a majority of the total number of citizen members appointed to the board of zoning appeals must be residents of the Town.
Term
Upon the establishment of a division of the board of zoning appeals, the members shall initially be appointed as provided in the zoning ordinance for the following terms of office: One (1) for a term of one (1) year; One (1) for a term of two (2) years; One (1) for a term of three (3) years; Two (2) for a term of four (4) years.
Members shall serve four (4) year terms
